“Preserve Your Records”: GOP-Controlled House Judiciary Committee Fires Off Fiery Threats To Jack Smith

Though Special Counsel Jack Smith is done for, losing his position before Trump’s Inauguration and dropping his two federal cases against now-President-Elect Donald Trump, the House Judiciary Committee isn’t done with him. In fact, it recently sent him a fiery letter demanding he preserve his records for investigation.

As background, Turning Point USA founder and Trump ally Charlie Kirk wrote, “🚨BREAKING: Jack Smith’s prosecution is OVER: ‘The DOJ, where Jack Smith works, cannot prosecute a sitting president… Fox News is told that Jack Smith will be gone from his post as special counsel, meaning the cases will be gone before Trump takes the oath of office on January 20.’ I’m not tired of winning.”

Explaining why Smith is done for, The American Tribune noted, “At issue with the Department of Justice is that it cannot prosecute a sitting president, something that it apparently acknowledged, presumably begrudgingly. As a result, it needs to end special counsel Smith’s attempts to prosecute former President Trump, as he will be the sitting president before long.”

Beginning the letter, which was sent by House Judiciary Committee Chairman Jim Jordan (R-OH) and Rep. Barry Loudermilk (R-GA), Chairman of the House Administration Subcommittee on Oversight, they said, “The Committee on the Judiciary is continuing its oversight of the Department of Justice and the Office of Special Counsel. According to recent public reports, prosecutors in your office have been “gaming out legal options” in the event that President Donald Trump won the election.”Continuing, they noted what it is that they are concerned about, saying, “With President Trump’s decisive victory this week, we are concerned that the Office of Special Counsel may attempt to purge relevant records, communications, and documents responsive to our numerous requests for information.”

Building on that, they noted that they have authority in this matter, saying, “The Office of Special Counsel is not immune from transparency or above accountability for its actions. We reiterate our requests, which are itemized in the attached appendix and incorporated herein, and ask that you produce the entirety of the requested material as soon as possible but no later than November 22, 2024.”

And, describing what they are demanding of Smith as his investigations wrap up, the letter noted, “Furthermore, this letter serves as a formal request to preserve all existing and future records and materials related to the Office of Special Counsel’s investigations and prosecutions of President Trump.”

They further noted that they won’t be tolerating the supposedly unintentional destruction or loss of documents, noting, “You should construe this preservation notice as an instruction to take all reasonable steps to prevent the destruction or alteration, whether intentionally or negligently, of all documents, communications, and other information, including electronic information and metadata, that are or may be responsive to this congressional inquiry.”

And, describing the broad swathe of information that Smith is expected to keep, they noted, “This instruction includes all electronic messages sent using official and personal accounts or devices, including records created using text messages, phone-based message applications, or encryption software.”
